1. Purpose and scope

These Terms and Conditions govern the purchase of products through gabum.com, an online store operating under the trading name GABUM.

By placing an order through this website, the customer declares that they have read and accepted these Terms and Conditions, as well as the privacy, cookie, shipping and returns policies available on the website.

2. Products

GABUM makes every reasonable effort to display the characteristics, photographs, dimensions, colours, specifications and other information relating to its products as accurately as possible.

Product photographs and representations are provided for information purposes. Minor differences in colour, finish or appearance may occur due to factors such as the screen used, photographic lighting or the characteristics of the product itself.

Product availability is subject to stock levels at the time of purchase.

3. Prices and taxes

Prices displayed on the website are expressed in euros (€), unless expressly stated otherwise.

The final price applicable to the order, including applicable taxes, will be displayed before the purchase is confirmed. The applicable VAT rate may vary depending on the country of delivery in accordance with current tax regulations.

Shipping costs are not necessarily included in the product price and will be displayed separately before the order is completed.

GABUM may change its prices at any time. Changes will not affect orders that have already been confirmed, except in the event of an obvious pricing error.

4. Ordering process

To make a purchase, customers must select the desired products, add them to their shopping cart and follow the steps indicated during checkout.

Before confirming the order, customers can review the selected products, quantities, delivery address, shipping method, shipping costs, taxes, payment method and total price, and can correct the information entered where necessary.

Once an order has been placed, the customer will receive an email confirmation containing the relevant purchase information.

The customer is responsible for providing complete, accurate and up-to-date information, particularly regarding the delivery address and contact details.

5. Availability and cancellation of orders

All orders are subject to availability.

If a product becomes unavailable after an order has been placed, GABUM will inform the customer as soon as possible and, as appropriate, offer cancellation of the product or order and refund any amounts paid.

GABUM may cancel an order in the event of an obvious error in the price or product description, inability to supply the product, reasonable suspicion of fraud or any other circumstance that legitimately prevents completion of the transaction. If payment has already been collected, the corresponding refund will be issued.

6. Payment methods

Customers may use the payment methods available and displayed during checkout.

Payments may be processed by third-party payment service providers. GABUM does not store full bank card details when payment processing is carried out directly by the corresponding payment provider.

The order may be subject to successful payment authorisation and confirmation.

7. Shipping and delivery

Available destinations, shipping methods, prices, estimated delivery times and other delivery conditions are detailed in our Shipping Policy.

Delivery times are estimates and may be affected by weekends, public holidays, carrier incidents, force majeure events or other circumstances beyond GABUM's reasonable control.

Customers must provide a correct and complete delivery address. Additional costs caused by an incorrect or incomplete address attributable to the customer may be charged where legally permitted.

Once an order has been dispatched, and where supported by the shipping service used, the customer will receive tracking information.

8. Right of withdrawal and returns

As a general rule, consumers have 14 calendar days from receipt of the order to exercise their right of withdrawal without having to provide a reason, except where an exemption is established by law.

Where a return is made due to withdrawal or a change of mind, return shipping costs are borne by the buyer. GABUM may provide a prepaid return label and deduct its cost from the amount to be refunded, after informing the customer in advance.

Where the product received is incorrect, damaged or lacks conformity, GABUM will bear the corresponding costs in the cases required by law.

Products must be returned under the conditions set out in our Returns Policy. Customers must contact GABUM before sending a return in order to receive the corresponding instructions.

The right of withdrawal may not apply in cases provided for by law, including certain goods made to the consumer's specifications or clearly personalised goods, and certain sealed goods which are not suitable for return for health protection or hygiene reasons once unsealed.

9. Refunds

Refunds will be made using the same payment method used for the purchase unless another permitted method has been expressly agreed.

In cases of withdrawal, refunds will be issued in accordance with the time limits and conditions established by applicable legislation and our Returns Policy. Where applicable, GABUM may wait until the goods have been received or until the consumer provides evidence that they have been returned before issuing the refund.

10. Legal guarantee and defective products

Products sold by GABUM are covered by the applicable statutory legal guarantee.

In Spain, new goods are subject to a statutory liability period for lack of conformity of three years from delivery, under the conditions established by applicable legislation.

Where a lack of conformity exists, consumers are entitled to the remedies provided by law, which may include repair or replacement and, where appropriate, a price reduction or termination of the contract.

The statutory legal guarantee is independent of any additional commercial warranty offered by the manufacturer.

11. Proper use of products

Customers must use products in accordance with their intended purpose, instructions, safety warnings and manufacturer's recommendations.

GABUM shall not be liable for damage resulting from incorrect, negligent or improper use contrary to the product instructions, without prejudice to any liability that cannot legally be excluded.

12. Liability

GABUM will comply with its obligations under applicable law and will not limit or exclude any rights or liabilities that are mandatory by law.

GABUM shall not be liable for failures or delays resulting from events beyond its reasonable control, without prejudice to the rights granted to consumers by applicable legislation.

13. Data protection

Personal data provided during the purchasing process will be processed in accordance with our Privacy Policy and applicable data protection legislation.

14. Changes to these Terms and Conditions

GABUM may update these Terms and Conditions when necessary due to legal, technical or commercial changes or changes relating to the operation of the store.

The terms applicable to each purchase will be those in force at the time the order is placed.

15. Applicable law and jurisdiction

These Terms and Conditions are governed by Spanish law, without prejudice to any mandatory protections applicable to consumers residing in other countries.

In the event of a dispute involving a consumer, the competent courts shall be determined in accordance with the applicable consumer protection legislation.
